Consultation on changes to the Fitness to Practise and Registration Rules

Thank you for your input to help shape the approach to take. We are now analysing your responses and will use these to inform our conclusions. These will be presented to our Council for approval in due course; we will then publish a document setting out the responses we have had, our assessment of them and our conclusions.

The Department of Health will be taking a similar approach for their consultation. Subject to the consultation results and a successful parliamentary process, we aim to introduce the changes set out in our consultation in early 2015.

Details of the consultation

The NMC, in parallel with the Department of Health, is proposing four amendments to the FtP and Registration Rules to enable us to deal with allegations against nurses and midwives more efficiently and effectively. The proposed changes consulted upon are:

  • Introducing Case Examiners into the FtP process;
  • The ability to review “no case to answer” decisions;
  • Changes to the composition of a registration appeal panel; and
  • The ability to request and verify registration information.

Each proposed change has a corresponding proposed amendment to the Nursing and Midwifery Order that will give effect to the proposed Rule changes. The proposed changes to the Order are contained in the Department of Health consultation. The Department of Health consultation also consults on the additional issue of clarifying the ability of the NMC to make a striking off order in health or lack of competence cases.
